<p>提案指出，這五位大法官為使裁判得以作成，採取「拒絕參與評議之大法官不計入現有總額」的計算路徑，形同由裁判者自行改寫審判權組織成立之前提要件，逾越憲訴法所設的正當程序界線，扭曲憲法增修條文所明定大法官十五人合議的組織意旨；在僅有少數大法官參與的情況下，作成影響重大法律制度的憲法判決，甚至介入立法程序自主權，對權力分立與憲政秩序造成嚴重衝擊。</p>
